Welcome to the www.balayageaftercare.co.uk website terms and conditions of supply (“T&Cs”). 

www.balayageaftercare.co.uk (“Website”) is a site operated by WS Beauty Limited, a company registered in England under company number 11805849 and with our registered office at 68 Lupus Street, London, SW1V 3EQ. WS Beauty Limited will be your contracting partner if you decide to place an order on the Website.

Balayage Aftercare Website store is hosted on Shopify Inc who provide Balayage Aftercare with the online e-commerce platform that allows us to sell our products and services to you.

By using the Website or placing an order, you agree to be bound by these T&Cs and any additional conditions and policies referred to herein and/or available by hyperlink (together, the “Terms”). The Terms apply to all users of the Website, including without limitation, users who are browsers, vendors, customers, merchants and/or contributors of content.

In addition, by using the Website, you affirm that you are of legal age to agree to the Terms or, if you are not, that you have obtained parental or guardian consent to enter do so. If you are not of legal age to agree to the Terms and have not obtained parental or guardian consent to agree to the Terms, then you may not use the Website. This website is not intended for persons younger than 13 years of age. If you are under 13 years of age, you should not provide your personal information on this website.

If you do not agree to these Terms, you must not use or access the Website.

You should print a copy of these Terms or save them to your computer for future reference. The details of your specific contract will not be kept by us. Every time you wish to place an order and purchase products, please check these Terms to ensure you understand and agree to the terms which will apply at that time. These terms were most recently updated on 26 March 2021.

1. Contacting us

2. Our Products

a) Pictures, illustrations or descriptions or any other information submitted or contained in this Website or other advertising matter are for general information and guidance. There may be minor variations between the products as shown or described on our Website and those dispatched to you without affecting their function, quality or price. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the products. The packaging of the products may vary from that shown on images on our Website.

b) All products shown on our Website are subject to availability. We will inform you by email as soon as possible if the product you have ordered is not available and we will cancel this item from your order. Usually we don't take payment until we have dispatched your order. However, if we do take payment, we will refund you the full amount as soon as possible, and in any event within 30 calendar days of the day of our notification. For the avoidance of doubt other products ordered by you in the same or separate orders will be dispatched in the normal way.

3. Our contract with you

a) Our Website will guide you through the steps you need to take to place an order with us.

b) Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.

c) We will confirm our acceptance to you of your order by sending you a shipping confirmation email to the email address you have given to us when submitting your order (Dispatch Confirmation). The contract between you and us will only be formed when (and not before) we (i) have received settlement of all sums due in respect of the products and (ii) have sent you the Dispatch Confirmation. You may not cancel or vary your order once it has been accepted, except in accordance with section [-] below.

d) If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because of an error in the price on our website, we will not process this product with your order and you will receive notification within the rest of your order. Usually we don't take payment until we have dispatched your order. However, if we do take payment, we will refund you the full amount as soon as possible, and in any event within 30 calendar days of the day of our notification.

4. Product Prices and Payment

a) The prices of the products will be as quoted on our website from time to time. We take all reasonable care to ensure that prices shown in our website are accurate at the time you place your order. If an error is found prior to dispatch of the products, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or re-credit you for any sum that has been paid by you or debited from your debit/credit card for the products.

b) If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

c) Prices for our products may change from time to time, but changes will not affect any order which we have confirmed with a shipping confirmation email. The price of a product includes VAT (where applicable). We cannot refund any VAT charges, except where the entire price of the product has been refunded. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect. The price of a product does not include delivery charges.

d) Payment for products ordered can be made by any method shown in this website at the time you place your order. All payments are taken in British Pounds. All purchases are inclusive of VAT (if applicable) at the prevailing rate. Payment for the products and all applicable delivery charges is in advance.

e) Only one promotional code or discount can be used when submitting an order (unless expressly permitted by the terms and conditions of the offer, code or discount).

5. Delivery

a) The costs and methods of delivery will be displayed to you on the individual product pages and during checkout. 

b) Ordered products will normally be delivered within the time set out on our Delivery Page, unless otherwise notified to you by us, and, in any event, within 30 days after the date on which we accept your order.

c) If we are unable to deliver the products within 30 days of sending you the Dispatch Confirmation, we will inform you as soon as possible and you will be entitled to cancel the contract and obtain a refund or re-credit for any sum that has been paid by you or debited from you credit card for the products and their delivery if: (a) we have refused to deliver the products; (b) delivery within the delivery deadline was essential (taking into account all the relevant circumstances); or (c) you told us before we accepted your order that delivery within the delivery deadline was essential. If you do not wish to cancel the contract straightaway, or we do not deliver the products within 30 days of our shipping confirmation email for your order and you do not have the right to cancel your contract under the preceding sentence, you can give us a new deadline for delivery, which must be reasonable, and you can cancel the contract if we do not meet the new deadline. Note: this section only applies to consumers.

d) We are not responsible for delays outside our control and, except as set out in section 4(c), we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

e) Our products will only be delivered in the United Kingdom. Users from outside of the United Kingdom, purchasing our products must indicate a delivery address in the United Kingdom and delivery outside of the United Kingdom must be organised by the you. If you choose to access the Website from other locations other than the United Kingdom, you do so on your own initiative and at your own risk and are responsible for compliance with local laws, rules and regulations, if and to the extent local laws, rules or regulations are applicable.

6. Your right of cancellation and refund

a) Balayage Aftercare offers a 100% satisfaction promise, so if you don't like any of your purchases for whatever reason, simply return them within 28 days of receiving them and we'll give you a replacement or your money back (special terms apply to certain products). This promise is in addition to your statutory rights (see section 5(b) below). 

b) You have a legal right to cancel a contract no longer than 14 calendar days after the day on which you receive the products. This means that during this time if you change your mind or for any other reason you decide you do not want to keep a product, you can notify us of your decision to cancel the contract and receive a refund. Please note that this right to cancel does not apply to items which are unsuitable for return due to health protection, hygiene or personalisation reasons or have been unsealed after delivery. If you wish to cancel your order in accordance with your statutory rights before receiving the products, please provide the information in the format set out in the Returns Form at the bottom of these T&Cs. Alternatively, if you have already received the items, you must return them to us without undue delay by following the returns process set out on the Returns page.

c) You will receive a full refund of the price you paid for the products. Please note that we are permitted by law to reduce this refund to reflect (or require you to pay to us an amount equal to) any reduction in the value of the products caused by your handling them in a way which would not be permitted in a shop.

7. Our liability to you

SECTION 7 ONLY APPLIES IF YOU ARE A CONSUMER

a) We only supply the products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We shall be under no liability in respect of any defect in the goods arising from fair wear and tear, wilful damage, negligence, abnormal usage conditions, failure to follow our instructions, misuse or alteration or repair of the ordered goods without our approval.

b) We do not in any way exclude or limit our liability for (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) anything for which liability cannot be excluded by applicable law.

8. If you are an Balayage Aftercare Representative

a) We reserve the right to refuse to accept or cancel any order placed by you where:

i) we reasonably believe that you are bulk buying products that are not for personal use or consumption; or

ii) we reasonably believe that you have made use of a customer only discount code that we have promoted when purchasing products that are not for personal use or consumption.

b) Nothing in these Terms limit or exclude our liability for (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); (d) defective products under the Consumer Protection Act 1987; or (e) anything for which liability cannot be excluded by applicable law.

c) Subject to section 8(b), we will under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the contract for any loss of profits, sales, business, or revenue; loss or corruption of data, information or software; loss of business opportunity; loss of anticipated savings; loss of goodwill; or any indirect or consequential loss. Our total liability to you in respect of all other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the products.

d) We do not give any representation, warranties or undertakings in relation to the products. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law, regulation or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the products are suitable for your purposes.

9. Our right to vary these terms

a) We may revise these Terms at any time but, in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when you placed your order. We will post the new version of the Terms on the Website and any orders placed after this time will be subject to the new version.

10. Events outside of our control

a) We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control. If an Event Outside Our Control takes place that affects the performance of our obligations under a contract our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

11. Other important terms

a) We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

b) Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

c) If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

d) These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

1.1 These terms and conditions of use ("Terms") explain how you may use this website and any of its content ("Site"). These Terms apply between WS Beauty Limited ("we", "us" or "our") and you, the person accessing or using the Site ("you" or "your").

1.2 The Site is not intended for persons younger than 13 years of age. If you are under 13 years of age, you should not provide your personal information on the Site.

1.3 You should read these Terms carefully before using the Site. By using the Site or otherwise indicating your consent, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should stop using the Site immediately.

2.2 You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Site.

2.3 We make no promise that the Site is appropriate or available for use in locations outside of the UK. If you choose to access the Site from locations outside the UK, you acknowledge you do so at your own initiative and are responsible for compliance with local laws where they apply.

2.4 We try to make the Site as accessible as possible. If you have any difficulties using the Site, please contact us using the contact details at the top of this page.

2.5 As a condition of your use of the Site, you agree to comply with our "Acceptable Use Policy" set out at Schedule 1 to these Terms and agree not to:

2.5.1 misuse or attack our Site by knowingly introducing viruses, trojans, worms, logic bombs or any other material which is malicious or technologically harmful (such as by way of a denial-of-service attack), or

2.5.2 attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site.

2.6 We may prevent or suspend your access to the Site if you do not comply with these Terms or any applicable law.

3. Registration and Password Security

3.1 Use of the Site may require registration, particularly in order to access restricted areas of the Site.

3.2 We are not obliged to permit anyone to register with the Site and we may refuse, terminate or suspend registration to anyone at any time.

3.3 You are responsible for making sure that your password and any other account details are kept secure and confidential.

3.4 If we have reason to believe there is likely to be a breach of security or misuse of the Site through your account or the use of your password, we may notify you and require you to change your password, or we may suspend or terminate your account.

when we are notified, but we cannot be responsible if you have failed to provide us with the relevant information.

7.1 While we try to make sure that the Site is secure, we do not actively monitor or check whether information supplied to us through the Site is confidential, commercially sensitive or valuable.

7.2 Other than any personal information which will be dealt with in accordance with our Privacy Policy, we do not guarantee that information supplied to us through the Site will be kept confidential and we may use it on an unrestricted and free-of-charge basis as we reasonably see fit.

10.1.2 losses that were not caused by any breach on our part;

10.1.3 business losses; and

10.1.4 losses to non-consumers.

11. Events Beyond our Control

We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control, including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.

12. Rights of third parties

No one other than a party to these Terms has any right to enforce any of these Terms.

13. Variation

13.1 No changes to these Terms are valid or have any effect unless agreed by us in writing or made in accordance with this clause 15.

13.2 We reserve the right to vary these Terms from time to time. Our updated Terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.

14. Disputes

14.1 We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with us, please contact us as soon as possible using the contact details set out at the top of this page.

14.2 Relevant United Kingdom law will apply to these Terms. If you want to take court proceedings, the relevant courts of the United Kingdom will have non-exclusive jurisdiction in relation to these Terms.

ACCEPTABLE USE POLICY

1. Prohibited uses

1.1 You may use the Site only for lawful purposes. You may not use the Site:

1.1.1 in any way that breaches any applicable local, national or international law or regulation;

1.1.2 in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;

1.1.3 for the purpose of harming or attempting to harm minors in any way;

1.1.4 to bully, insult, intimidate or humiliate any person;

1.1.5 to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;

1.1.6 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or

1.1.7 to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

1.2 You also agree not to access without authority, interfere with, damage or disrupt:

a) any part of our site;

b) any equipment or network on which the Site is stored;

c) any software used in the provision of the Site; or

d) any equipment or network or software owned or used by any third party.

2. Interactive services

2.1 We may from time to time provide interactive services on the Site.

2.2 Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

2.3 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on the Site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on the Site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

3.5.8 infringe any copyright, database right or trade mark of any other person;

3.5.9 be likely to deceive any person;

3.5.10 breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

3.5.12 be in contempt of court;

3.5.13 be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;

3.5.14 be likely to harass, upset, embarrass, alarm or annoy any other person;

3.5.15 impersonate any person or misrepresent your identity or affiliation with any person;

3.5.16 give the impression that the Contribution emanates from Balayage Aftercare or one of its affiliates;

3.5.17 advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.

3.5.18 contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; and

3.5.19 contain any advertising or promote any services or web links to other sites.

 

3. Privacy Statement for Customers

1. Who is responsible for your personal information

This Privacy Statement applies to the personal information of Avon customers using the Avon Shopify website.  References to “Balayage Aftercare”, “us”, “we” or “our” in this Privacy Statement mean WS Beauty Limited, or one of its affiliates, subsidiaries or joint ventures.  Avon will be a controller of your personal information in any scenario where we determine the means and purposes of processing of such information.

2. Personal information we collect about you

When using the term “personal information” in this Privacy Statement, we mean information that relates to you and allows us to identify you, either directly or in combination with other information that we may hold. We obtain this information directly from you when you place an order, set up a customer account with us, or use our website. We may collect the following personal information about you:

  • Your name and contact details (title, surname, first name, any other name(s), postal address(es), e-mail address, telephone numbers)
  • Your date of birth
  • Information on your purchases from Balayage Aftercare, and information about your preferences for particular types of products

We use a third party payment gateway to take payment for any orders placed, but Balayage Aftercare does not process or store payment details.

3. How and why we use the personal information that we collect

We use your personal information for the following purposes:

  • To fulfil your order
    When you place your BalayageAftercare order, we use your personal information to fulfil that order.  We may contact you by email and/or SMS to send you confirmation of your order, payment and order status.  This is to meet our contractual obligations to you.
  • To inform you about our products and offers that you may like
    If you have signed up to our Balayage Aftercare Newsletter or purchased from us previously, we may send you email and/or SMS communications about our products and offers.  We may also, from time to time, inform you of opportunities to become an Balayage Aftercare Representative as part of our marketing communications; which you will only receive if you have opted to receive them.  Such marketing communications are sent on the basis of your consent, which you can withdraw at any time by contacting us as set out below. We may use the information we have about you (including your purchasing history) to build a profile about your preferences, and to send you products and offers tailored to you. You may also see advertising related to Balayage Aftercare products across the web on the basis of the information we hold about you. This is to meet our legitimate business interests in marketing our products effectively. If you do not want to receive marketing communications (e.g. emails) from us, please contact us.  Where you interact with Balayage Aftercare by posting or messaging on social media, we may use personal information included in social media posts for this purpose.
  • To improve our services, fulfil our administrative purposes and protect our business interests
    The business purposes for which we will use your personal information include accounting, billing, security and legal purposes (including to investigate complaints or claims, and to administer the Balayage Aftercare product guarantee and any other rights to return products), statistical and marketing analysis, systems testing, maintenance and development. This will include the use of your personal information to comply with our legal obligations, for example, our obligation to maintain records for tax and audit purposes. Where there is no specific legal obligation we are required to meet, we process this personal information to meet our legitimate interests in managing our business and keeping our records accurate and up to date.
  • To request your participation in product reviews
    We may contact you to ask you to participate in product reviews.  This may be for a product you have purchased, a sample provided by Balayage Aftercare or a product we think you may be interested in.  We process this information on the basis of our legitimate interest to improve our product offering.  If you choose to participate, the processing of the information relating to your participation and review is carried out on the basis of your consent, which you can withdraw at any time by contacting us..
  • To administer competitions you enter and incentive schemes you have signed up for
    We run certain competitions, and will need to process your name and contact details if you enter, as well as to let you know if you have won. We do this on the basis of your consent, which you can withdraw at any time by contacting us as set out below. Specific uses of personal data in this context will be detailed in the competition rules. 

If you object to the use of your personal information to fulfil any of the purposes set out above, please contact us.  Whilst your decision to provide your personal information to Balayage Aftercare is generally voluntary, if you do not provide certain information Balayage Aftercare may not be able to accomplish some of the purposes outlined in this Privacy Statement. For example, we may not be able to post products to you without knowing your postal address.

4. How we may share or transfer the data we collect

We may share your personal information with:

  • Balayage Aftercare Representatives, Balayage Aftercare Sales Leaders and Balayage Aftercare Zone Managers;
  • suppliers providing services to us in order to help us run our business and improve our services and your customer experience;
  • an acquiring party, service providers or other third parties in connection with the consideration, negotiation, or completion of a transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets; and
  • government authorities.

This sharing will be for the purposes set out above (including the engagement of third party service providers, who may act as controllers of your personal information) or to comply with specific legal obligations to which we are subject.

Balayage Aftercare uses appropriate safeguards to protect personal information which is transferred to countries outside of the European Economic Area which are considered to provide a lower level of protection for personal information.  European Commission-approved Standard Contractual Clauses and other legally acceptable transfer mechanisms are in place as necessary.  Contact us using the details set out below to see a copy of the relevant safeguards. 

5. How long we keep your personal information

We will retain your personal information for as long as is necessary to fulfil the purposes for which it was collected.  Order processing information will be kept by Balayage Aftercare for 10 years or until tax audit close, whichever is later.  Balayage Aftercare may use your personal information while you are active with Balayage Aftercare.  In deciding how long to keep personal information after you cease to be active with Balayage Aftercare, we take into account any ongoing obligations we may have (e.g. to store the information for accounting purposes) or the length of time given to commence or defend any legal claims.  If you would like more specific timescales please contact us, and we will provide them where we can. We will stop processing your data for direct marketing, including profiling activities, if you object to such processing of your data or if you withdraw your consent to processing, where your consent has previously been obtained.

6. Your rights

You have a right to request access to the personal information that we hold about you and to have any inaccurate personal information we hold about you rectified.  You may also have the right to restrict the processing of your personal information, to port your personal information to another controller or to have your personal information erased.
